Property Owners Should Be More Careful When Making Direct Payments to Subcontractors

In Action Concrete Contractors, Inc. v. Chappelear, the supreme court affirmed the circuit court’s grant of summary judgment to a subcontractor to enforce its lien against the property owner.

Chappelear (Owners) hired Premier Southern Homes LLC (Premier) as the general contractor to construct a model home.  The price was $300,000.  Premier hired various subcontractors including Action Concrete Contractors, Inc. (Subcontractor).  Premier did not pay Subcontractor’s final bill of $66,862.63. Continue reading
