From Bad to Worse?: Some Early Speculation About the Roberts Court and the Constitutional Fate of the Poor

Rev. 851 (2008) Initially recognizing the Supreme Court’s rejection of treating the poor as a suspect class under the Equal Protection Clause, Professor Siegel’s essay further examines the constitutional caselaw involving the Court’s treatment of class. The essay’s exploration reveals a more nuanced treatment of class than the above characterization of the Court’s rejection would indicate. Although past caselaw reflects a certain willingness by the Court to offer constitutional protection to the economically disadvantaged, the essay interprets recent decisions as an indication that class may receive less respect from the Roberts Court.
