The Roberts Court's Continued Neglect of Adequacy and Equity Concerns in American Education

In her article, Professor James discusses the Parents Involved decision in the context of the recent trend toward resegregation. The article examines the benefits of racial integration in public schools, supporting integration as a compelling interest that justifies school districts’ consideration of race in making school assignments. The article ultimately concludes that by striking down the plans presented in Parents Involved, the Court further entrenched unequal educational opportunity for children of color, while also closing the door on one of the few remaining options available for school districts seeking to directly and efficiently integrate schools and provide adequate education for all students.
