In an attempt to predict how the Roberts Court will deal with sex discrimination cases, Professor Cohen’s article surveys the position held by Justice Kennedy in previous decisions. Through its analysis of Justice Kennedy’s jurisprudence regarding sex equality, Professor Cohen’s article anticipates future Court decisions in which Justice Kennedy will shift the balance more toward a traditional and paternalistic view of the world.
