Is the Use of In-House Counsel Right for South Carolina Insurance Defense Cases?

In 2006, the South Carolina Ethics Advisory Committee issued opinion 06-12, an opinion that approved the use of in-house counsel in insurance defense. The ethics opinion limited its analysis to the South Carolina Rules of Professional Conduct and failed to include SC Code Ann. § 40-5-320, which prohibits the corporate practice of law. This Comment will analyze the use of in-house counsel in insurance defense and determine whether this practice constitutes the unauthorized practice of law.
